Crimes against humanity

<div><img src="http://www.eccc.gov.kh/sites/default/files/imagecache/node-gallery-disp…; alt="" align="none"></div><div>Crimes against humanity constitute a category of crimes defined under international law and applied to cases before the Extraordinary Chambers in the Courts of Cambodia. In accordance with Article 5 of the ECCC Law, the ECCC can prosecute alleged crimes against humanity committed during the period from 17 April 1975 to 6 January 1979 under the regime of Democratic Kampuchea. In order to be prosecuted before teh ECCC, the allged crimes must have constitute a crime agianst humanity in international customary law between 1975-1979.</div><div><br></div><div>Crimes against humanity are any acts committed as part of a widespread or systematic attack directed against any civilian population, on national, political, ethnical, racial or religious grounds, such as:</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>murder;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>extermination;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>enslavement;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>deportation;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>imprisonment;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>torture;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>rape;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>persecutions on political, racial, and religious grounds;&nbsp;</div><div>•<span class="Apple-tab-span" style="white-space:pre"> </span>other inhumane acts.</div><div><br></div><div>The Supreme Court Chamber in its decision on appeals in case 001 concluded that rape did not exist as a separate crime against humanity under international customary law between 1975-1979, but in the context of Case 001 rape could be subsumed under the crime against humanity of torture. In the context of Case 002, the Pre-Trial Chamber considered that rape could constitute a crime against humanity of other inhumane acts.</div>
