Office of the Co-Investigating Judges

There are one Cambodian and one international Co-investigating Judge at the Extraordinary Chambers in the Courts of Cambodia. The scope of what the Co-Investigating Judges judges can investigate is defined by Introductory and Supplementary Submissions from the Co-Prosecutors.

The Co-Investigating Judges shall perform independent, impartial investigation  , and they are obliged to search for both inculpatory as well as exonerating evidence. The Co-Prosecutor's,  the defence lawyers and the lawyer's for Civil Parties can make investigative requests to the Co-Investigating Judges requesting specific actions to be taken by the Co-Investigating Judges.

After the Co-Investigating Judges have completed their investigation, the will issue a Closing Order, which will contain either an indictment sending the case for trial, or a dismissal order. A case can be dismissed for lack of evidence or for lack of jurisdiction.

The decisions made by the Co-Investigating Judges are subject to appeal to the Pre-Trial Chamber.
