Deadline for Complaints in Case 002

On 14 January 2010, the Co-Investigating Judges notified all parties to the proceedings that they consider the judicial investigation in Case File 002 to be concluded. While the Co-Investigating Judges’ announcement signifies that the judicial investigation is in its final stages, there remains time and opportunity for additional evidence to be gathered and placed on the Case 002 case file. 
 
Rule 49 of the ECCC Internal Rules vests the Co-Prosecutors with the ongoing duty to evaluate complaints or information alleging commission of crimes within the jurisdiction of the ECCC.  Where the Co-Prosecutors receive complaints or information relevant to an ongoing judicial investigation, they may forward such complaints or information to the Co-Investigating Judges to be placed on the case file as evidence.   Complaints or information may be submitted through the Victims Unit to the Co-Prosecutors by any person, organisation or other source who witnessed or was a victim of crimes within the jurisdiction of the ECCC, or who has information regarding such alleged crimes.   While there is no specified deadline for accepting complaints in the Internal Rules, the Co-Prosecutors are of the view that a deadline for accepting complaints concerning Case 002 is necessary for legal and logistical purposes.    
 
In consultation with the Victims Unit, the Co-Prosecutors have set Monday 8 February 2010 as the deadline for accepting complaints that can be forwarded for inclusion in Case File 002 during the judicial investigation stage.  Any person wishing to file a complaint concerning Case 002 should do so by provision to the Victims Unit no later than this date.
 
This deadline does not preclude or discourage any person from filing complaints after the above date; however, to ensure a complaint has the greatest possibility of being accepted as evidence in Case File 002, filing before this date is strongly advised.
