The Co-Prosecutors, Chea Leang and Fergal Gaynor, announce that Khieu Samphan was transferred on Monday, January 30, 2023, to Kandal Provincial Prison to continue to serve his two life sentences.

Today, the Supreme Court Chamber upheld convictions against Khieu Samphan - Head of State of Democratic Kampuchea and one of the most senior leaders of the Khmer Rouge - for genocide, crimes against humanity and grave breaches of the 1949 Geneva Conventions.

Pursuant to the ECCC’s Internal Rule 54, the National Co-Prosecutor hereby issues the following public press statement with regard to the status of case file 004 with Yim Tith as being the accused:

On 28 December 2021, the Supreme Court Chamber (SCC) issued its decision dismissing the International Co-Prosecutor’s (ICP) appeal requesting the SCC to send the case against Yim Tith to the ECCC Trial Chamber for trial. The appeal was based on the ECCC’s legal framework that includes a ‘default mechanism’ requiring a case to go to trial unless at least four of the five Pre-Trial Chamber (PTC) Judges overturn the Indictment, which they did not do in their September 2021 decision.

The International Co-Prosecutor (“ICP”) issues this press release to clarify her position on a possible misunderstanding of the judicial status of outstanding cases at the ECCC as a result of incomplete reporting by Voice of America radio, in Khmer, of statements recently made by the Court’s Administration Public Relations spokesman. 

The International Co-Prosecutor (“ICP”) is compelled to issue this press release in response to the inaccurate, unsupported allegations of misconduct leveled in the press release issued by Meas Muth’s Defence lawyers on 20 July 2021, which vents their frustration at the Pre-Trial Chamber’s proper exercise of its discretion in denying the Defence request to file supplemental pleadings to the Chamber.

The Co-Investigating Judges today notified all parties in Cases 004 and 004/01 that they consider the judicial investigation against Ao An in Case 004 to be concluded. They further ordered the severance of the proceedings against Ao An from Case 004 and the creation of a new case file, 004/02.

 STATEMENT BY THE OFFICE OF THE CO-PROSECUTORS ON CASE 004/01 

Following the nomination by the United Nations Secretary-General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, Mr. Olivier Beauvallet (France) has been appointed as new International Judge to serve in the Pre-Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC). Judge Beauvallet replaces Judge Chang-ho Chung (Republic of Korea) who resigned from his post effective of 28 February 2015.

Media reports indicate that questions have arisen at recent court outreach events concerning whether there will be more cases at the ECCC after Cases 003 and 004. The International Co-Prosecutor, Nicholas Koumjian, reiterates that the consistent policy of his office remains as first announced by his predecessor on 8 September 2009: no further cases will be submitted to the Co-Investigating Judges.

ECCC Internal Rule 54 requires that any Introductory or Supplementary submission by the Co-Prosecutors shall be confidential documents. It provides however that the Co-Prosecutors “may provide the public with an objective summary of the information contained in such submissions.” Accordingly, taking into consideration the interests, security and privacy of victims and witnesses, the rights of suspects who are entitled to the presumption of innocence, and the requirement of rules that the investigation shall be confidential, the International Co-Prosecutor provides the following information.
