First appeal hearings scheduled in Case 002/01

The Supreme Court Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has scheduled the first hearings relating to appeals in Case 002/01 to hear the testimony of three  witnesses, which it decided to call by decision of 29 May 2015. The hearings are scheduled to take place from 09:00 – 16:00 on 2, 3 and 6 July 2015, with 7 July as a reserve day, should additional time be required.

Distribution of Trial Chamber Judgement in Case 002/01

The Office of Administration of the Extraordinary Chambers in the Courts of Cambodia (ECCC) will distribute the printed version of the Trial Chamber’s judgement in Case 002/01 to around 300 students from different universities in Phnom Penh on 12 May 2015 at the ECCC main Courtroom at 09:00. The distribution ceremony will be presided over by Acting Director of the Office of Administration H.E. Kranh Tony. There will also be a Questions and Answers session related to the latest developments of the ECCC.    

The Court Report - April 2015

The April 2015 issue of the Court Report has been published. It features continued testimony in Case 002/02 and details on new charges in Cases 003 and 004. It also includes information about the inauguration of the memorial to victims of Democratic Kampuchea at Tuol Sleng.Each section's judicial updates are included, as well as the continued activities of the Public Affairs section’s outreach programme. 

New appointments as International Judge in the Pre-Trial Chamber and Reserve International Co-Prosecutor

Following the nomination by the United Nations Secretary-General Ban Ki-moon, and the approval by the Supreme Council of the Magistracy, Mr. Olivier Beauvallet (France) has been appointed as new International Judge to serve in the Pre-Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC). Judge Beauvallet replaces Judge Chang-ho Chung (Republic of Korea) who resigned from his post effective of 28 February 2015.

Revised budget for 2014-2015 published

The revised budget for the Extraordinary Chambers in the Courts of Cambodia (ECCC) for the period 2014-2015 has been approved, and is now available on the ECCC website. The revised budget for the year 2015 totals US$33.8 million, of which US$27.1 million is for the international component and US$6.7 million is for the national component. The budget for 2014 was revised on the basis of expenditures of US$27.8 million, of which US$ 21.7 million were  expenditures incurred by the international component and expenditures of US$ 6.1 million by the national component.

The Court Report March 2015

The March 2015 issue of the Court report has been published, and features the decision by the International Co-Investigating Judge to charge in absentia two suspects in Cases 003 and 004. There is a summary of the witnesses and civil party testimony heard so far. Also featured is information on the International Women’s Day celebrations at the ECCC. Each section's judicial updates are included, as well as the continued activities of the Public Affairs section’s outreach programme.

The International Co-Investigating Judge charges Ao An in Case 004

On 27 March 2015, the International Co-Investigating Judge charged Ao An with the following alleged crimes: premeditated homicide, as a violation of the 1956 Cambodian Penal Code, allegedly committed at Kok Pring execution site, Tuol Beng security centre and Wat Au Trakuon security centre; and the Crimes against Humanity of murder, extermination, persecution on political and religious grounds, imprisonment, and other inhumane acts (namely inhumane conditions of detention) at Kok Pring execution site, Tuol Beng security centre and Wat Au Trakuon security centre.

Changes in Case 002/02 hearing schedule from 30 March to 3 April 2015

The Trial Chamber of the Extraordinary Chamber in the Court of Cambodia (ECCC) will hear the testimony of a Witness (2-TCW-923) by video-link from the U.S. Due to the time difference the Chamber will sit from 8 a.m. to 10 a.m. for three mornings (Phnom Penh time) from 30, 31 March and 1 April 2015. The Chamber does not envisage further hearings on those days and Hearings on Civil Party suffering will be held on 2-3 April from 9 a.m.

Inauguration of the Memorial to Victims of the Democratic Kampuchea Regime at Tuol Sleng Genocide Museum

On Thursday 26 March, at 8:30 a.m., the Victims Support Section (VSS) of the Extraordinary Chambers in the Courts of Cambodia (ECCC) together with the Ministry of Culture and Fine Arts of the Royal Government of Cambodia will inaugurate a Memorial to Victims of the Democratic Kampuchea Regime at Tuol Sleng Genocide Museum in Phnom Penh.

Changes in Case 002/02 hearing schedule 23-27 March 2015

In order to provide the parties a first opportunity to review the new disclosure of Case 004 statements relevant to Case 002, there will be no trial hearing in Case 002/02 on Monday 23 March 2015.  The next trial hearings in Case 002/02 will therefore be held on Tuesday 24 March, Wednesday 25 March and Thursday 26 March.The hearings will be broadcast live on the ECCC website:www.eccc.gov.kh/en/live-stream

The Court Report - February 2015

Oral order prohibiting the publication of photographs and images of a witness

The Extraordinary Chambers in the Courts of Cambodia (ECCC) wishes to inform representatives of media that the following oral order was issued on 19 February 2015 by Trial Chamber President Nil Nonn:“The Chamber has granted protective measures for witness 2-TCW-944, including non-disclosure of his address and not making his image available to the public. In covering this trial, the media are ordered not to publish any photographs or images of the witness, regardless of when they were taken.”

Changes to the Case 002/02 hearing schedule

A number of witness statements from Case 004 relevant to Case 002/02 were disclosed by the Co-Prosecutors on 16, 17 and 18 February 2015. In order to give the Parties time to review the recently disclosed documents, the following changes have been made to the trial schedule in Case 002/02:

Revision 9 of the ECCC Internal Rules

The 11th ECCC Plenary Session, which concluded on 16 January 2015, adopted a number of amendments to the Internal Rules. Revision 9 of the ECCC's Internal Rules, which contain these amendments, were today placed on the ECCC website. In accordance with Rule 1(1) of the ECCC Internal Rules, these revised Rules are now in effect.Courtesy copies of all three language versions of the revised Rules are available on the ECCC website as follows:  

Japan makes US$1.39 million contribution

The Government of Japan has made a new contribution of US$1,385,567 to the international component of the Extraordinary Chambers in the Courts of Cambodia (ECCC).  Japan is the largest donor to the ECCC, and with this recent contribution, Japan has provided final assistance exceeding of US$82 million, representing approximately 36 per cent of the total contributions to the court.

11th ECCC Plenary adopts amendments to the Internal Rules

The 11th Plenary Session of the Extraordinary Chambers in the Courts of Cambodia (ECCC) concluded this afternoon, having been reconvened after an adjournment on 16 October 2014.

Case 002/02 hearing will resume on 21 January 2015

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has been informed by the Khmer Soviet Friendship Hospital that Khieu Samphan will not be discharged from the hospital before 15 January 2015. Consequently, the trial hearing scheduled for that day has been cancelled.

Misconduct of Khieu Samphan's counsel referred to professional bodies

On 19 December 2014, the Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) issued an order, referring the misconduct of Khieu Samphan’s national Co-Lawyer Kong Sam Onn to the President of the Bar Association of the Kingdom of Cambodia, and referring the misconduct of foreign Co-Lawyers Arthur Vercken and Anta Guisse to the President of the Paris Bar Association and the Prosecutor General of the Paris Appeal Court.

Trial Chamber orders appointment of standby counsel for Khieu Samphan

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has denied a request from the Co-Prosecutors to appoint an amicus curiae counsel on a temporary basis, and has ordered the Defence Support Section to appoint one international and one national Court Appointed Standby Counsel for Khieu Samphan.

Statement by the international Co-Prosecutor regarding ECCC caseload

Media reports indicate that questions have arisen at recent court outreach events concerning whether there will be more cases at the ECCC after Cases 003 and 004. The International Co-Prosecutor, Nicholas Koumjian, reiterates that the consistent policy of his office remains as first announced by his predecessor on 8 September 2009: no further cases will be submitted to the Co-Investigating Judges.

ECCC visits former Khmer Rouge strongholds

9 districts in Oddar Meancheay, Battambang and Pailin, all located in former Khmer Rouge strongholds, were visited by representatives from the Office of the Co-Investigating Judges and the Public Affairs Section between 12 and 22 November 2014. In close co-operation with the respective District Governors, the ECCC organized nine public forums in Anlong Veng, Trapeang Prasat, Banteay Ampil, Samlaut, Pailin, Sala Krau, Sampov Lun, Phnim Proek and Kamrieng. Each forum was attended by an average of 300 people who came to learn more about the ongoing court proceedings.

Hearings in Case 002/02 adjourned until January 2015

The Trial Chamber of the Extraordinary Chambers in the Courts of Cambodia (ECCC) has adjourned trial hearings in Case 002/02 until 09:00 on 8 January 2015. The adjournment is a consequence of the continued refusal of counsel for Khieu Samphan to participate in the proceedings in Case 002/02 before 29 December 2014, when the brief on Khieu Samphan’s appeal in Case 002/01 is due.
