Complaints to OCP

The prosecution of crimes by the ECCC can be initiated by the Co-Prosecutors, either at their own discretion or on the basis of a complaint. The Co-Prosecutors receive and consider such complaints that allege commission of crimes within the jurisdiction of the ECCC. These complaints can be lodged by any person, organization or other source who witnessed was a victim of or has knowledge of such alleged crimes. A complaint may also be prepared or lodged on behalf of a victim by a lawyer or a Victims’ Association. These complaints do not automatically initiate criminal prosecution. The Co-Prosecutors decide, at their discretion, whether to reject the complaint, include the complaint in an ongoing preliminary investigation, conduct a new preliminary investigation or forward the complaint to the Co-Investigating Judges. The Co-Prosecutors inform the complainant of the decision as soon as possible after registration of the complaint.
