<div><b>Rule 74. Grounds for Pre-Trial Appeals</b></div><div><i>(Amended on 1 February 2008 and 9 February 2010)</i></div><div><br></div><div>1. No appeal shall lie against decisions of the Co-Investigating Judges where the matter has already been heard by the Chamber pursuant to the dispute settlement provisions in Rule 72.</div><div><br></div><div>2.<span class="Apple-tab-span" style="white-space:pre"> </span>The Co-Prosecutors may appeal against all orders by the Co-Investigating Judges. </div><div><br></div><div>3. The Charged Person or the Accused may appeal against the following orders or decisions of the Co-Investigating Judges:</div><div>4. a)<span class="Apple-tab-span" style="white-space:pre"> </span>confirming the jurisdiction of the ECCC; </div><div>b)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for investigative action allowed under these IRs; </div><div>c)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for the restitution of seised items; </div><div>d)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for expert reports allowed under these IRs; </div><div>e)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for additional expert investigation allowed under these IRs; </div><div>f)<span class="Apple-tab-span" style="white-space:pre"> </span>relating to provisional detention or bail; </div><div>g)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing an application to seise the Chamber for annulment of investigative action; </div><div>h)<span class="Apple-tab-span" style="white-space:pre"> </span>relating to protective measures or i)<span class="Apple-tab-span" style="white-space:pre"> </span>declaring a Civil Party application admissible.</div><div><br></div><div>4. Civil Parties may appeal against the following orders by the Co-Investigating Judges:</div><div>a)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for investigative action allowed under these Rules; </div><div>b)<span class="Apple-tab-span" style="white-space:pre"> </span>declaring a Civil Party application inadmissible; </div><div>c)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for the restitution of seised property; </div><div>d)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for expert reports allowed under these IRs;</div><div>e)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing requests for further expert investigation allowed under these IRs; f)<span class="Apple-tab-span" style="white-space:pre"> </span>a Dismissal Order where the Co-Prosecutors have appealed; </div><div>g)<span class="Apple-tab-span" style="white-space:pre"> </span>refusing an application to seise the Chamber for annulment of investigative action; or </div><div>h)<span class="Apple-tab-span" style="white-space:pre"> </span>relating to protective measures.</div><div><br></div><div>5. Any non-party to the investigation proceedings who has requested the return of seised items shall be entitled to appeal against any order of the Co-Investigating Judges denying such request.</div>
