<p class="MsoNormal">The abuse of process doctrine has been developed through practice
in international case law. Under this doctrine a court can decline to exercise
its jurisdictions in cases where the accused rights has been so seriously
violated, that a continuation of the proceedings would contravene the court’s
sense of justice.<span style="mso-spacerun: yes">&nbsp; </span>In cases where
the serious violation has been caused by other authorities than the court
itself, the abuse of process doctrine would normally only be applied if:<o:p></o:p></p>
